राज्यसभा में लोकपाल विधेयक के प्रस्तुतीकरण के लिए राष्ट्रपति कि पूर्व अनुमति कि आवश्यकता  


राज्य सभा में लोकपाल बिल प्रस्तुति के समय कुछ समाचार पत्रों में कुछ भ्रामक खबरें छपी थी कि लोकपाल बिल को राज्यसभा में प्रस्तुत करने से पूर्व राष्ट्रपति का अनुमोदन आवश्यक था| ऐसी खबरें वास्तव में निम्न मिथ्य आधारों पर छपी थी   

• लोकपाल बिल लोकसभा से कई संशोधनो के बाद पारित हो सका|

वास्तविकता-- संविधान में ऐसा कुछ नहीं है कि किसी बिल के लिए सिर्फ इसलिए राष्ट्रपति का अनुमोदन आवश्यक है क्योंकि वह बिल संसद के एक सदन में कई संशोधनों के बाद  अपनाया गया है |

•   क्योंकि लोकपाल का खर्च भारत की संचित निधि पर भारित होगा एवं  संविधान के अनुच्छेद 117 (3) के अनुसार ऐसे किसी बिल कि किसी सदन में प्रस्तुति से पूर्व राष्ट्रपति का अनुमोदन आवश्यक है|

वास्तविकता-- लोकपाल बिल कि लोकसभा में प्रस्तुति से पूर्वे ही राष्ट्रपति का अनुमोदन ले लिया गया था एवं अलग से राज्यसभा के लिए अनुमोदन कि आवश्यकता नहीं थी| परन्तु अनु० 117(3) में शब्दों कि जटिलता के कारण ऐसा प्रतीत होता है कि राज्यसभा के लिए अलग से अनुमोदन कि आवश्यक थी|

मगर यह दिलचस्प है,कि  अनुच्छेद 117 (1) में पहले से स्पष्ट है कि अनु० 110  में वर्णित किसी भी धन विधेयक को केवल लोक सभा में ही रखा जा सकता है|

मेमोगेट प्रकरण (मुलेन मेमो विवाद)

अमेरिकी-पाकिस्तानी उधोगपति मंजूर इजाज़ ने खुलासा किया कि पाक राजदूत हुसैन हक्कानी ने उसे एक गोपनीय ज्ञापन ओबामा प्रशासन में एडमिरल माइक मेमो तक तक पहुँचाने को कहा था|

इस ज्ञापन में पाकिस्तान सरकार ने ओबामा प्रशासन से जनरल कयानी और जनरल पाशा को कड़े एवं स्पष्ट संदेश देने का आग्रह किया गया था, जो नागरिक सरकार के लिए खतरा बनते जा रहे हैं| इसके बदले में पाकिस्तान ने अमेरिका को निम्न प्रस्ताव दिए थे|

·         ओसामा प्रकरण कि स्वतंत्र एवं जबाबदेह जांच

·         एक राष्ट्रीय सुरक्षा दल का गठन जो भविष्य में पाकिस्तान में अमेरिका के इस प्रकार के किसी भी ऑपरेशन को सीध्री मंजूरी देगा और ISI में आतंकवादियों से संपर्क रखने वालो के खिलाफ कार्यवाही करेगा|

·         परमाणु कार्येक्रम के लिए नया फ्रेम वर्क बनाया जाएगा| 

·         मुंबई हमलों के दोषियों  को सजा दिलाने में भारत की मदद चाहे वो दोषी सरकार या ख़ुफ़िया संस्था के ही क्यूँ ना हो|

 वास्तव में पाकिस्तान कि नागरिक सरकार पर एक बार फिर से तख्ता पलट का खतरा मंडरा रहा है इसी लिए जरदारी प्रशासन ने ओबामा से मदद मांगी थी| हालांकि इस प्रकरण कि  सच्चाई कि पुष्टि नहीं हो पाई परन्तु सेना और विपक्षी पार्टियों के दवाब में पाक राजदूत हक्कानी को इस्तीफा देना पड़ा|

The Bill seeks to provide for the surveillance, inspection and
operation of all dams of certain parameters to ensure their safe
functioning.

The law is applicable to Andhra Pradesh and West Bengal (and Union Territories) because their Legislatures passed a resolution for an Act of Parliament. It may apply to any other state if they pass a resolution on the matter.

A National Committee on Dam Safety is to be established with the Chairman, Central Water Commission as the Chairperson and at least 11 other specified members. It shall meet at least twice a year.
The functions of the National Committee include
(a) monitoring the functioning of state or non-state dam safety organisations;
(b) evaluating dam safety procedures in various states and suggest ways to improve dam safety practices consistent with international practices and Indian conditions;
(c) evolving a comprehensive dam safety management approach; and
(d) advise on specific matters of dam safety to the central or state governments.

The central government shall establish a Central Dam Safety Organisation within the Central Water Commission. Its functions include providing technical and managerial assistance to State Dam Safety Organisations (established by the state government); maintain a data-base of all specified dams including distress conditions; maintain records of major dam failures; and resolve disputes between state dam safety organisations. The states shall establish a State Committee on Dam Safety if they have more than 20 dams. The Committee shall review the work of the State Dam Safety Organisations, recommend measures for safety of a specified dam, and establish priorities among projects of remedial safety works.


In states with less than 20 dams, there shall be a State Dam Safety Cell headed by a Superintendent Engineer. Every dam owner (other than central and state governments) owning more than 10 specified dams shall establish Non-State Dam Safety Organisation.
In states without the state committees, the progress of work of the State Dam Safety Organisation shall be undertaken by the

National Committee on Dam Safety through the Central Dam Safety Organisation.
